Terms of Use for iKofi Platform

1.

Introduction

Welcome to ikofi platform. These Terms of Use ('Terms') constitute a legally binding agreement between you ('User', 'you', or 'your') and ikofi ('we', 'us', or 'our'). By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2.

Eligibility

To use our services, you must be at least 13 years old. Users between 13 and 18 years old may only use the service with verifiable parental or legal guardian consent. You must be capable of forming a legally binding contract and not be barred from using digital wallet services under applicable laws. Business accounts must be opened by authorized representatives who are at least 18 years old.

3.

Account Registration and Security

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must use strong passwords, enable two-factor authentication when available, and notify us immediately of any unauthorized access or security breaches. We reserve the right to verify your identity and information at any time.

4.

User Responsibilities

Users must: 4.1 maintain accurate and up-to-date account information; 4.2 comply with all applicable laws and regulations; 4.3 use the service only for legitimate purposes; 4.4 maintain adequate security measures on their devices; 4.5 report any suspicious activities; 4.6 maintain sufficient funds for any fees or charges. Users are solely responsible for backing up their transaction data and maintaining records as required by law.

Service Description

Our platform provides digital wallet services including: 5.1 daily money tracking; 5.2 money transfers; 5.3 payment processing; 5.4 transaction history tracking; 5.5 account management tools. We may modify, suspend, or discontinue any part of our services at any time with notice. Services may be subject to transaction limits, processing times, and fees as disclosed in our Fee Schedule.

Fees and Charges

ikofi provides its services free of charge to users. We will notify you via email or within the application of any changes to our Terms of Service at least 30 days prior to such changes taking effect. Users have the right to review updated terms and discontinue use of the service if they do not agree with the modifications.

7.

Transaction Processing

While we save your transaction history for ease of use and tracking, transactions are processed by your bank or carrier. We do not have direct authority over transaction processing. Any failed or delayed transactions should be addressed directly with your bank or carrier. We provide transaction records for your reference, but resolution of transaction issues requires contacting your financial institution or service provider.

Privacy and Data Protection

Our Privacy Policy, incorporated by reference into these Terms, details how we collect, use, share, and protect your information. By using our services, you consent to our data practices as described in the Privacy Policy. We comply with applicable data protection laws and implement appropriate security measures to protect your information.

9.

Intellectual Property

All content, features, and functionality of our platform, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, are our exclusive property or that of our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services or included software.

Law and Regulations

Our platform operates under Rwandan law. Users must comply with all applicable laws, including but not limited to financial services regulations, anti-money laundering laws, and tax regulations. We cooperate with law enforcement and regulatory authorities as required by law.

11.

Prohibited Activities

Prohibited activities include but are not limited to: 11.1 illegal transactions; 11.2 money laundering; 11.3 terrorist financing; 11.4 fraudulent activities; 11.5 unauthorized business activities; 11.6 harassment or abuse; 11.7 providing false information; 11.8 attempting to gain unauthorized access; 11.9 using automated systems or bots; 11.10 violating others' rights; 11.11 circumventing our policies or security measures.

12.

Service Limitations and Modifications

We do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue any service features with notice. Maintenance, upgrades, or security issues may cause temporary service interruptions. We are not liable for any damages resulting from such interruptions.

13.

Disclaimers and Limitations of Liability

Our services are provided 'as is' without any warranties. We are not liable for indirect, incidental, special, or consequential damages arising from your use of our services. Our liability is limited to the amount of fees paid by you for the service in question during the three months preceding the incident.

14.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: 14.1 your use of our services; 14.2 your violation of these Terms; 14.3 your violation of any rights of another party; 14.4 your violation of any applicable laws or regulations.

15.

Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through: 15.1 informal negotiation; 15.2 mediation in Rwanda; 15.3 binding arbitration in Rwanda. The prevailing party in any legal action shall be entitled to recover reasonable attorney's fees and costs.

16.

Account Suspension and Termination

We may suspend or terminate your account: 16.1 for violations of these Terms; 16.2 if required by law or regulation; 16.3 if we suspect unauthorized or fraudulent activity; 16.4 for extended periods of inactivity; 16.5 if you provide false information. Upon termination, you remain liable for any outstanding obligations, and certain Terms survive termination.

17.

Changes to Terms

We may modify these Terms at any time by posting updated Terms on our platform. Continued use of our services after such changes constitutes acceptance of the modified Terms. Material changes will be notified to users at least 30 days in advance. If you disagree with any changes, you must stop using our services.

18.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. We may replace any unenforceable provision with a valid provision that most closely matches the intent of the original provision.

19.

Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of war, cybersecurity incidents, changes in law or regulations, telecommunications failure, or power outages.

20.

How to Delete Your Account

To delete your iKofi account, simply email us at team@ikofi.app with the subject line 'Account Deletion Request'. What happens next: 1. We will respond to your request within 24 hours 2. Your personal information will be anonymized within 30 days 3. Transaction records will be retained in anonymized form (required for financial system integrity) 4. Your phone number will be subject to a 90-day cooling period (see 'Account Creation Restrictions') Important: Please ensure all pending transactions are completed before requesting deletion. 21.

Account Creation Restrictions

To maintain platform stability and ensure responsible use of our services: 1. Phone numbers associated with deleted accounts will be subject to a mandatory 90-day cooling period 2. During this period, the phone number cannot be used to create a new iKofi account 3. This restriction helps us: • Maintain database integrity and system performance • Prevent abuse of our services • Ensure stable and reliable service for all users • Protect the security of our financial platform This policy is essential for maintaining the quality and reliability of our services. Users who attempt to circumvent this restriction may face permanent account suspension.
